A Wal-Mart plastic bag lawsuit has been filed by a Nebraska man who claims an Wal-Mart plastic bag filled to the brim with groceries was handed to his wife and after a can fell on her toe, it led to an infection which later killed her.
According to the Associated Press report released Thursday, William Freis said that the failure of a Bellevue Wal-Mart clerk to properly bag their groceries, back in 2010, led to a fatal infection that ultimately took to Lynette Freis'life.
The lawsuit says a cashier placed two 42-ounce cans of a La Choy product and a 2-pound bag of rice in a single bag and handed it to Lynette Freis.
The bag broke as she carried it to her car, the lawsuit says, and one of the cans fell on her right big toe, cutting and fracturing it. The injuries led to an infection that spread through her body and, despite antibiotics, hospitalizations and two surgical procedures, "ultimately resulted in her death on March 12, 2011."
The Wal-Mart plastic bag lawsuit goes on to claim Wal-Mart failed to properly train their employees on proper bag techniques, including when to double bag and what the limit is for each bag.
The Wal-Mart lawsuit seeks nearly $657,000 for medical and funeral expenses, plus an unspecified amount for her pain and suffering and the loss to her husband.
According to the report, Wal-Mart has not responded to the lawsuit, only that the major retailer is seeking to move the case to federal court.
