Kristin Cavallari wants full custody of her three kids, Camden, 7, Jaxon, 5, and Saylor, 4, because of her husband Jay Cutler's misconduct.
On Sunday, the couple announced their split from their ten-year relationship. The former Chicago Bears quarterback filed his divorce petition on April 21, where he asks joint custodians and joint decision-makers of their three children.
Kristin Cavallari and Jay Cutler File Divorce Petition
Cutler states in his petition that he "has always been available at home as a parent and primary caretaker" of the minors. Still, Cavallari counteracted and said that she "has been the primary residential parent" of the kids, as stated in her complaint file on April 24.
The founder of "Uncommon James" wants to be "the primary residential custodian" of their children, and the former NFL star will be given "reasonable periods of parenting time."
Cavallari is requesting that her ex-husband pay child support "in an amount consistent with the Tennessee Child Support Guidelines" or as deemed by the court. Apart from that, she also wants the 36-year-old quarterback to pay their kids' insurance and all uncovered dental, medical, eye care, orthodontic, prescription drugs, and all other health-related expenses.
Jay Cutler cited "irreconcilable differences" for the grounds of separation, while Cavallari cited the same with an addition of "inappropriate marital conduct." Both did not agree on the date of their formal separation. Cavallari stated that separation happened on the day that they returned to the US that is on April 7, after spending several weeks in the Bahamas.
Cavallari also stated in her filing that Cutler had conducted inappropriate marital misconduct, which makes "cohabitation unsafe and improper."
She also indicated in her divorce petition that any misconduct filed against her is a result of her ex-husband's misconduct against her. However, Cutler did not allege his ex-wife with misconduct in his petition.
